The Supreme Court Will Rule on Judicial Funding On Tuesday. According To Executive Order 10(EO 10)

On December 7, the Supreme Court will rule on a lawsuit filed by 36 state governments against the federal government over a funding dispute for superior courts in the states and the legitimacy of President Muhammadu Buhari’s Executive Order 10.

The court’s Registry has now given notices to the parties advising them of the upcoming ruling, according to information obtained on Sunday.

The states sued on behalf of their Attorneys General, with the Attorney General of the Federation (AGF), who represents the federal government, identified as the lone defendant.
After hearing final statements from lawyers for the parties and the five amici curiae invited, a seven-member panel of the court, led by Justice Musa Dattijo Muhammad, announced on October 4 that judgment would be deferred until a date to be informed to the parties.

While the states argue, among other things, that the Federal Government is responsible for all capital and recurrent expenditures of all courts established under Section 6 of the Constitution, the Federal Government disagrees.

The plaintiff states also seek the court to nullify President Muhammadu Buhari’s Executive Order 10 on judicial finance, notably at the state level, which he issued in 2020.
